A Texas judge has said an attorney who's locked up in a psychiatric facility can continue representing clients while she's there, the Austin American-Statesman reported Friday.
That lawyer, Carolyn Barnes, has been in an inpatient psychiatric facility since mid-2011, when a judge ruled she wasn't competent to stand trial on charges that she fired a gun at a census worker.
During her time in the psychiatric facility, Barnes has continued practicing as an attorney. A state appeals court had questioned whether she was competent to do so, and it asked Judge Doug Arnold to weigh in.
"Ms. Barnes is, as of this moment, a licensed member of the bar," Judge Doug Arnold said. "It wouldn't be appropriate for me to unilaterally decide if she's competent to act as an attorney."
Earlier this month, the American-Statesman reported Barnes filed a lengthy appeal for a client accused of misdemeanor theft. At the Kerrville State Hospital, she has access to everything she needs to do her job, including the Internet and a fax machine.
After she was arrested for allegedly firing shots at the census worker, Barnes was accused of assaulting a police officer, the American-Statesman reported in 2010.
Williamson County Jail records show Barnes has been arrested eight times, including once for allegedly making a terrorist threat, Austin, Texas' KXAN.com has reported.

NEWTOWN, Conn. -- The gunman who slaughtered 20 children and six adults at a Connecticut elementary school may have snapped because his mother was planning to commit him to a psychiatric facility, according to a lifelong resident of the area who was familiar with the killer's family and several of the victims' families.

Adam Lanza, 20, targeted Sandy Hook Elementary School in Newtown after killing his mother early Friday because he believed she loved the school "more than she loved him," said Joshua Flashman, 25, who grew up not far from where the shooting took place. Flashman, a U.S. Marine, is the son of a pastor at an area church where many of the victims' families worship.

"From what I've been told, Adam was aware of her petitioning the court for conservatorship and (her) plans to have him committed," Flashman told FoxNews.com. "Adam was apparently very upset about this. He thought she just wanted to send him away. From what I understand, he was really, really angry. I think this could have been it, what set him off."

A senior law enforcement official involved in the investigation confirmed that Lanza's anger at his mother over plans for "his future mental health treatment" is being looked at as a possible motive for the deadly shooting. "He thought she just wanted to send him away. From what I understand, he was really, really angry."

Flashman was told Nancy Lanza had begun filing paperwork to get conservatorship over her troubled son, but that could not be confirmed because a court official told FoxNews.com such records are sealed. The move would have been necessary for her to gain the legal right to commit an adult to a hospital or psychiatric facility against his will. A competency hearing had not yet been held.

Adam Lanza attended the Sandy Hook School as a boy, according to Flashman, who said Nancy Lanza had volunteered there for several years. Two law enforcement sources said they believed Nancy Lanza had been volunteering with kindergartners at the school. Most of Lanza's victims were first graders sources believe Nancy Lanza may have worked with last year.

Flashman said Nancy Lanza was also good friends with the school's principal and psychologist—both of whom were killed in the shooting rampage.

"Adam Lanza believed she cared more for the children than she did for him, and the reason he probably thought this [was the fact that] she was petitioning for conservatorship and wanted to have him committed," Flashman said. "I could understand how he might perceive that—that his mom loved him less than she loved the kids, loved the school. But she did love him. But he was a troubled kid and she probably just couldn't take care of him by herself anymore."

The Washington Post reported that the distraught mother had considered moving with her son to Washington state, where she had found a school she thought could help him. Either way, according to Flashman, Nancy Lanza was at her wit's end.

A separate neighborhood source also told FoxNews.com that Nancy Lanza had come to the realization she could no longer handle her son alone. She was caring for him full-time, but told friends she needed help. She was planning to have him involuntarily hospitalized, according to the source, who did not know if she had taken formal steps.

Multiple sources told FoxNews.com Adam Lanza suffered from Asperger's syndrome , a form of autism, and other unspecified mental and emotional problems.

Adam Lanza has also been described by those who knew him as highly intelligent, and a spokesman for Western Connecticut State University told The Associated Press he took college classes there when he was 16, earning a 3.26 grade point average and excelling at a computer course.

Alan Diaz, 20, who was friends with Adam Lanza at Newtown High School, said the Lanza he knew was ill-at-ease socially, but not a monster.

"He was a wicked smart kid," Diaz told FoxNews.com by email. "When I first met him, he wouldn't even look at you when you tried to talk to him. Over the year I knew him, he became used to me and my other friends, he eventually could have full conversations with us.

"I've heard him laugh, he has even comforted me once in a hard time I had," Diaz said. "A big part of me wishes I never dropped contact with him after he left high school, felt like I could have done something."

Flashman said nobody will completely understand why Adam did what he did.

"No one can explain Adam Lanza besides God and Adam Lanza, and I don't even think Adam Lanza could explain Adam Lanza, to be honest with you."

Minnesota moved a step closer to reforming its troubled sex offender program Monday, with a recommendation that the Legislature create a network of regional treatment facilities to serve as alternatives to the current high-cost, high-security system. The recommendation, from a task force headed by former state Supreme Court Chief Justice Eric Magnuson, is the latest effort to solve the thorny question of how to protect the public from dangerous sex offenders while not violating their constitutional rights.
Minnesota moved a step closer to reforming its troubled sex offender program Monday, with a recommendation that the Legislature create a network of regional treatment facilities to serve as alternatives to the current high-cost, high-security system.
The recommendation, from a task force headed by former state Supreme Court Chief Justice Eric Magnuson, is the latest effort to solve the thorny question of how to protect the public from dangerous sex offenders while not violating their constitutional rights.
The state faces a federal lawsuit by several offenders who argue that the Minnesota Sex Offender Program (MSOP) subjects them to illegal indefinite detention without adequate therapy.
The MSOP was created in 1994 to confine and treat the most dangerous sex offenders under court commitment after they have finished their prison sentences. But the program has discharged only two offenders since its creation, and some argue that commitment amounts to a de facto life sentence. The program's population has ballooned to more than 600 offenders confined in high-security treatment facilities at a cost of approximately $120,000 annually per patient.
Chief U.S. Magistrate Arthur Boylan ordered the state to form the task force of jurists, lawmakers and other professionals to find less restrictive options to the prison-like treatment centers.
Rep. Jim Abeler, R-Anoka, who serves on the task force, said the judge is giving Minnesota time to find solutions, but that the clock is ticking for lawmakers. In coming months, he said, they will have to wade through the politics of an emotionally charged issue.
"There's a lot of third rails in politics. This is certainly one of them,'' Abeler said. "Showing kindness to sex offenders is not something people like to do. The challenge that's going to come at the end of the day is where do you put these people? It's going to have to be in Minnesota somewhere."
The alternative, he said, might be a federal takeover of what has been a state program.

All or nothing

State Human Services Commissioner Lucinda Jesson, whose agency oversees the MSOP, said she will meet with lawmakers in coming weeks to discuss the task force recommendations. She said she does not foresee an end to the current high-security treatment program, but said the task force report offers alternatives.
"The problem with civil commitment is it's all or nothing,'' said Jesson, who convened the task force at the judge's urging. "You're either in this expensive high-security facility or you are not. I think that is a quandary that I agree that is a concern."
In its recommendations Monday, which are not binding, the task force said the Legislature must fund less-restrictive residential facilities and get programs to support them operating in a reasonable time. It also said lawmakers must clear any regulatory or legal obstacles that would prevent access to these alternatives, while also ensuring public safety. There must also be funding available for public education about rehabilitation of sex offenders.
The task force recommended distributing the less restrictive facilities throughout the state, which will require navigating local laws that may restrict or impede placement of the facilities for sex offenders.
The task force will continue its work next year, examining potential changes to the way sex offenders are selected for commitment to high-security facilities and how they can earn release from the program.

EXCLUSIVE: Inside Moose Lake, Where Sex Offender Vows to 'Sue My Way Out the Front Door'

With less than two weeks to go until a court-imposed deadline for proposals for less restrictive alternatives to Minnesota's current program for civilly committed sex offenders, one of the sex offenders who is part of the class-action lawsuit that forced the recommendations vows to "sue my way out the front door."

"I have remorse, I'm sorry for what I did, I'm sorry I grew up as a hateful person," explained Guy Greene, a 41 year-old from Minneapolis who the state has determined is a "sexually dangerous person" and has been committed since 2005.

"But I love life, I love people, I love my family. I want to go home to my family. I want to be a productive member of society," Greene said during an interview recently at the Minnesota Sex Offender Program facility in Moose Lake.
"I'm filing a civil rights complaint. I'm going to sue my way out the front door," Greene said.

Greene is one of the 669 sex offenders - all men except for one woman - committed to MSOP; they represent about four percent of the state's 17,500 registered sex offenders.

The MSOP sex offenders are part of a federal lawsuit that has been certified as class-action that has brought the state closer than ever to reforming the program, which is supposed to offer treatment to persons deemed to be "sexually dangerous" or who have a "sexually psychopathic personality."

Since 1993, not one "client," as the sex offenders are called, has ever successfully finished treatment and completely graduated from the program.

"Two decades have shown that they've been a failure in their treatment, in their attempt at providing treatment," declared Mike Benson, another civilly committed sex offender in Moose Lake who was convicted of raping a woman in 1989. He has been confined in MSOP since 1993.

Anne Barry, deputy commissioner at the Minnesota Department of Human Services which runs the MSOP, acknowledges the lack of provisional discharges.

"I don't think that we're satisfied that we've moved enough people through phases of treatment," Barry said in an interview.

"There need to be some changes if we are going to actually either move more people into the community who have been appropriately treated or if we divert some of those people who would otherwise come to us," said Barry.

DHS is awaiting the recommendations from the Sex Offender Civil Commitment Task Force, which is set to finalize its recommendations at a meeting Nov. 29th and present them to the department, the court, and the Legislature by Dec. 3.

"I can see no reason why we would not follow their recommendations," Barry told 5 EYEWITNESS NEWS.

The largest reforms may require Legislative action; the next session begins in January.

"In addition to our responsibility to make sure that, in fact, we're treating people, we also have a responsibility to the public safety," Barry said. "So there is pressure from all over the place."

Of the 669 sex offenders committed to the MSOP, only 10 - one percent - are in the final phase before they petition a judicial panel for a provisional discharge, according to DHS.

Minnesota has the highest number of civilly committed sex offenders per capita of any state.

Nearly three-quarters (72 percent) of the sex offenders in the MSOP are classified as Level 3, which the Department of Corrections defines as the "highest public risk" of re-offending.
